Rules for using H2O Hand Car Wash services, your VIP account, vehicles on file, and related customer tools.

These Terms and Conditions (“Terms”) govern your use of H2O Hand Car Wash websites, VIP account tools, text and email communications, and related services (collectively, the “Platform”). By creating or using a VIP account, completing account setup, purchasing services, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy.
Eligibility And Your Account
You must provide accurate information when staff create a VIP account for you, when you complete account setup, or when you update your profile. You are responsible for maintaining the confidentiality of your password and for activity that occurs under your account after setup is complete.
H2O may refuse, suspend, or deactivate accounts that contain inaccurate information, violate these Terms, pose a security risk, or are used in a way that interferes with lane operations or other customers.
Account Status Communications
Account status communications are service-related messages needed to create, operate, secure, or support your VIP account and H2O services. They are separate from marketing communications. By providing a mobile phone number or email address, you agree that H2O and our service providers may use those contact methods to send account status communications, including account-setup links, password or sign-in notices, receipts, purchase or account balance information, vehicle-add links, support responses, security notices, and other operational messages related to your account or services.
Account status communications may be sent by email, text message (SMS), or similar channels. They may use automated systems, may include time-limited links, and may be sent even if you opt out of marketing communications, unless applicable law requires otherwise or the message is not necessary to provide or secure the service.
Marketing Communications
Marketing communications are promotional or informational messages about washes, annual pass perks, locations, offers, and related services. Marketing communications are separate from account status communications and are optional.
Email marketing. Promotional email is sent only when we have recorded promotional email consent for your account. Consent to receive promotional email is not required to buy goods or services from H2O. You can unsubscribe from marketing email using the unsubscribe instructions in the message or by contacting us.
SMS marketing. Promotional text messages are sent only when we have recorded promotional SMS consent for your account. Consent to receive marketing texts is not required to buy goods or services from H2O. Marketing text message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
SMS opt-out and help. You can opt out of marketing texts at any time by replying STOP to a marketing message from us, where supported by the sending number, or by contacting us through our contact page. Allow a reasonable time for opt-out requests to be processed. For help, reply HELP where supported, or contact us directly.
During account setup, acceptance of these Terms and the Privacy Policy is required to finish your profile. Promotional email consent and promotional SMS consent are requested separately and are optional.
Vehicles, Photos, And Account Information
You agree to provide accurate vehicle details and license plate numbers. You may add vehicles through your account, through a secure link sent by staff, or with staff assistance at the lane. If you upload a license plate photo, you grant H2O permission to process that image to help read the plate number and attach the vehicle to your account.
Staff may record notes, purchase details, and service information related to your visits. You are responsible for keeping your contact information current so we can reach you about your account and services.
Purchases, Payments, And Rewards
Prices, packages, services, prepaid credits, annual memberships, and promotional rewards are subject to the descriptions, eligibility rules, and prices shown at the time of purchase. Payments may be processed through H2O staff tools and third-party payment providers. You authorize charges for purchases you request or approve at the lane.
Annual pass perks, wash-count rewards, and similar benefits apply only while your account and any required pass remain active and eligible. H2O may change prices, packages, locations, hours, and promotional programs at any time. Past purchases remain subject to the terms shown at the time of sale.
Acceptable Use
You may not misuse the Platform, attempt unauthorized access, scrape or harvest data, interfere with H2O systems, impersonate another person, or use account features for unlawful, abusive, harassing, or fraudulent purposes. You may not attempt to circumvent security controls, abuse secure links, or use the Platform in a way that could harm customers, staff, or H2O operations.
Third-Party Services
The Platform may rely on third-party providers for hosting, payment processing, email delivery, SMS delivery, vehicle photo processing, point-of-sale integrations, and other operational services. Your use of those features may also be subject to the third party’s terms and privacy practices. H2O is not responsible for third-party services outside our reasonable control.
Intellectual Property
The Platform, branding, website content, and related materials are owned by H2O or its licensors and are protected by applicable intellectual property laws. You may use the Platform only for personal, non-commercial account and service purposes. You may not copy, modify, distribute, or create derivative works from Platform materials except as allowed by law or with our written permission.
Disclaimers
The Platform and related account tools are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, H2O disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not guarantee uninterrupted, error-free, or secure operation of the Platform, text delivery, or linked services.
Limitation Of Liability
To the fullest extent permitted by law, H2O and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the Platform or H2O services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Platform or these Terms will not exceed the greater of (a) the amount you paid H2O for the specific purchase giving rise to the claim during the three months before the event, or (b) one hundred U.S. dollars (US $100), except where liability cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless H2O and its owners, employees, and service providers from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Platform, violation of these Terms, or violation of any law or third-party right.
Changes To These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Material changes may also be communicated through the Platform, by email, or by text where appropriate. Continued use of your VIP account after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires a different form of consent.
Termination
You may stop using the Platform at any time. H2O may suspend or terminate access to a VIP account, secure links, or messaging features if we reasonably believe doing so is necessary to protect customers, staff, systems, or legal compliance. Some purchase, billing, and account records may be retained as described in our Privacy Policy.
Governing Law And Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Platform will be brought in the state or federal courts located in Travis County, Texas, unless applicable law requires a different venue.
